Historical Commission Public Hearing on Change in Abutter Notification

(k) An “abutter” for purposes of the Commission is defined as including owners of properties on both sides of the street, road, path or driveway of the applicant and all properties within 50 feet of the applicant’s property boundary.
WESTPORT HISTORICAL COMMISSION
To Interested Party:
In accordance with Massachusetts General Law, Chapter 40C (Historic District), you are hereby notified that the Westport Historical Commission will hold a public hearing on the matter of changing the Westport Point Historic District abutter notifications from notice given to the owners of those properties located 300 feet from the boundary of that of an applicant for a Certificate of Appropriateness or a Certificate of Hardship to owners located within 50 feet of an applicant. The Clerk of the Commission shall also undertake identifying and notifying abutters as required.
A PUBLIC HEARING on the proposed changes will be held Monday, February 7, 2011 at 8:00 p.m. at the Westport Town Hall – Basement.
A. The proposal will change the wording on the Guidelines for the Westport Point Historic District, page 14, dated April 2010, Notice to Abutters, to read as follows: The Commission has established its definition of abutters to include all persons owning property within 50 feet of all boundaries of the applicant's property, including abutters across streets. The Clerk of the Commission shall obtain the list of abutters from the Town of Westport Online GIS and Property Survey data and shall notify those abutters.
B. The proposal will change the wording in Annex A, item k, of the Westport Historical Commission Rules and Regulations dated January 7, 2008, to read:

C. The proposal will change the wording on the instructions for the Application Form for a Certificate, Notice to Abutters to read:
Notice to Abutters
The Commission has established its definition of abutters to include all persons owning lots within 50 feet of all boundaries of the applicant’s site including abutters across streets and in all directions around the applicant. The Clerk of the Commission shall identify and notify such abutters at the addresses from the list obtained from the Town Of Westport Online GIS and Property Survey data. The Clerk shall also notify all others requiring notice.
