Subdivision Sureties and Snow Removal Discussion

Subdivision Sureties and Snow Removal Discussion

Members of the Town of Westport Planning Board will be present at the Board of Selectmen’s meeting on Monday, January 10, 2011 at 6:30 pm at Town Hall to discuss the process of calling subdivision sureties when developers default and also to discuss snow removal on private ways.

The Planning Board is charged with, among other things, formulating and administering Rules and Regulations Governing the Subdivision of Land in accordance with the Subdivision Control Law; advising on and reviewing plans for proposed subdivisions; and monitoring the installation of subdivision infrastructure and new road construction.

State law prohibits towns from maintaining, repairing and removing snow on private roads that are inaccessible to the public. However, public monies may, if the town so votes, be expended on private ways for removal of snow and ice. The expenditure of public funds to remove ice and snow does not make the private way become public.

For more information contact Town Planner Sarah Raposa at (508) 636-1037 or www.westport-ma.gov/planning to read about seizing subdivision surety and snow plowing on private ways.
